ReachMyTeach Privacy Policy

This Privacy Policy (the "Privacy Policy") applies to the ReachMyTeach websites, technology services, and other company software, services, or content ("Website" or "Websites" or "Site" or "Services") owned and operated by RMT Tech LLC ("ReachMyTeach," "we," "us," or "our"). We have created this Privacy Policy to tell you what information the Site collects, how we use that information, and who we will share that information with, if at all. This Privacy Policy does not address the privacy practices of any third parties that we do not own, control, or are affiliated with. Capitalized terms not defined in this Privacy Policy will have the meaning stated in our Terms of Use. This Privacy Policy explains our information practices. Your use of the Services is also governed by the applicable Terms of Use and, when the Services are provided through a school or district, the applicable agreement with that school or district.

We may update and make changes to this policy, so we encourage you to review it periodically.

Generally, we do not collect Personal Information from visitors to our website who are not registered users. However, if you decide to communicate with us, we may collect your full name, email address, School or Organization name, and job title in order to fulfill requests for demos of our service capabilities.

How Your Personal Information is Collected. We collect most of this personal information directly from you or the School using our Service—via the Site or by email, telephone, text, or other messaging technologies. However, we may also collect information from the following categories of sources:

Third-party service providers we use to provide our Services to you.
Third-party identity providers, such as Google or Microsoft, when an LEA enables single sign-on. We receive only the information authorized by the LEA and the identity provider for authentication and account access;
Cookies and similar technologies used for authentication, security, user preferences, and understanding use of the Services;
Automated collection of technical and usage information within the Services, including IP address, browser type, login activity, searches, click paths, time spent using features, and system logs. We do not access general browser history or collect GPS or precise device location;
Our IT systems, including:
Automated monitoring of our websites and other technical systems, such as our computer networks and connections, communications systems, and messaging technologies.

How and Why We Use Your Personal Information. We collect, store, and/or share your personal information for the following legitimate business purposes:

Performing Site Services: We utilize your contact details, identifiers, audio/visual data, professional or employment information, non-public education information, sensitive personal information, and inferences to:
- Deliver our Site and Services.
- Allowing users of the service to send you messages.
- Keep in touch with you.
- Provide customer support.
Account Setup: When you register with the Site, we collect identifiers and other identifiable information to set up your account.
Operational Activities: We use information as reasonably necessary for billing, invoicing, recordkeeping, service administration, surveys, compliance, audits, investigations, and other internal business operations.
Data Analysis: We analyze technical and usage information from activity within ReachMyTeach to understand service performance, feature use, trends, and statistics. We do not analyze general browser history or GPS location.
Service Improvement and Development: We use technical, usage, feedback, and de-identified information to maintain and improve the Services, identify and repair errors, and develop new features. We do not use Student Data or message content to train artificial intelligence models.
Security: We use contact details, identifiers, personal information, audio/visual data, professional or employment information, non-public education information, sensitive information, and inferences to the extent reasonably necessary to ensure the security and integrity of the Site.
Legal Compliance: We use contact details, identifiers, personal information, audio/visual data, professional or employment information, non-public education information, sensitive information, and inferences to comply with our legal and regulatory obligations.
Other Uses: We may use information for another purpose when directed or authorized by the applicable LEA, with appropriate consent, or as otherwise permitted or required by law.

Who We Share Your Personal Information With. In the preceding 12 months, we have shared users’ personal information with:

Specific users you choose to connect and communicate with through our Service, including schools, teachers, or service administrators.
Third-party service providers we carefully select and evaluate to help deliver our Services to you, such as:
- Lexikeet Language Services: On-demand human-to-human interpretation support;
- Amazon Web Services: Secure hosting and encrypted data management;
- Faria: Backend infrastructure and server support, including access to data when necessary to provide those services;
- Google Cloud: Enhanced platform functionality, including translation services;
- Twilio and SignalWire: Mobile messaging services;
- Postmark: Email communication management;
- SurveyJS: Forms and surveys;
- Unlayer: Newsletter creation; and
- OpenAI, provider of ChatGPT: Translation and writing assistance for translatable messages. ReachMyTeach does not provide Student Data to OpenAI and does not permit submitted content to be used for model training.
Third parties approved by you, including social media sites you choose to link your accounts.

We only allow our service providers to handle your personal information if we are satisfied that they take appropriate measures to protect your personal information. We also impose contractual obligations on service providers, contractors, and third parties to ensure they can only use your personal information to provide services to us and to you.

We may disclose and exchange information with law enforcement agencies and regulatory bodies to comply with our legal and regulatory obligations.

We may also need to share some personal information with other parties, such as potential buyers of some or all of our business or during a re-structuring. We will typically anonymize information, but this may not always be possible. The recipient of the information will be bound by confidentiality obligations.

Personal Information We Sold or Shared. We do not sell or share, as defined in the California Consumer Privacy Act of 2018 (CCPA) and as amended by the California Privacy Rights Act of 2020 (CPRA), your personal information and will not do so in the future without providing you with notice and an opportunity to opt-out of such sale or sharing.

Sensitive personal information

How Long Your Personal Information Will Be Kept. The applicable school or district retains control of data maintained through ReachMyTeach, including messages and other communications. Unless the LEA requests earlier deletion or applicable law requires otherwise, ReachMyTeach retains data for up to seven years after the associated account is deactivated, including deactivation resulting from graduation or another status change. Individual users should generally submit deletion requests through their school or district. OrangePasses data follows a separate retention approach and is retained only as long as reasonably necessary to provide the service, support the LEA’s operational needs, comply with applicable law, or follow the LEA’s instructions. OrangePasses data may be deleted upon termination or earlier at the LEA’s request, subject to standard backup practices and legal requirements.
Children. Student accounts cannot be created independently and must be created or authorized by an LEA for a school-directed educational purpose. The LEA is responsible for providing notices and obtaining any consents required by applicable law. ReachMyTeach uses Student Data only to provide school-authorized Services and not for independent commercial purposes or marketing to students or parents. If we learn that a child’s personal information was provided outside an authorized educational relationship or without required consent, we will work with the applicable LEA and take appropriate action, including deletion when required. Parents or guardians with questions should contact their school or district or email legal@reachmyteach.com.
Data Security. We prioritize the protection of your personal information and employ a range of security measures to safeguard it from accidental, unlawful, or unauthorized access, use, alteration, loss, destruction, or disclosure. These measures include technical, administrative, and physical safeguards designed to protect your data.
Marketing Communications. We may send marketing communications to school staff, administrators, and people who directly contact us or express interest in ReachMyTeach. We do not use parent or student information for marketing. Recipients may opt out using the unsubscribe instructions in the communication or by emailing legal@reachmyteach.com. Opting out of marketing does not affect operational or school-directed communications delivered through the Services.
Your Rights Under the CCPA/CPRA. If you are a resident of California, you have the right under the California Consumer Privacy Act of 2018 (CCPA), as amended by the California Privacy Rights Act of 2020 (CPRA), and certain other privacy and data protection laws, as applicable, to exercise free of charge:

Disclosure of Personal Information We Collect About You	You have the right to know and request disclosure of: • The categories of personal information we have collected about you, including sensitive personal information; • The categories of sources from which the personal information is collected; • Our business or commercial purpose for collecting, selling, or sharing personal information; • The categories of third parties to whom we disclose personal information, if any; and • The specific pieces of personal information we have collected about you. Please note that we are not required to: • Retain any personal information about you that was collected for a single one-time transaction if, in the ordinary course of business, that information about you is not retained; • Reidentify or otherwise link any data that, in the ordinary course of business, is not maintained in a manner that would be considered personal information; or • Provide the personal information to you more than twice in a 12-month period.
Disclosure of Personal Information Sold, Shared, or Disclosed for a Business Purpose	We do not sell your personal information, nor do we share it for targeted behavioral advertising. We only share your personal information with third parties as necessary to provide our services. Since sharing certain personal information is essential for us to deliver our services, users are unable to opt-out of this sharing. However, you have the right to know: The categories of personal information about you that we shared and the categories of third parties to whom the personal information was shared; and The categories of personal information that we disclosed about you for a business purpose and the categories of persons to whom the personal information was disclosed for a business purpose.
Right to Limit Use of Sensitive Personal Information	We only use and disclose your sensitive personal information as necessary to: Perform the services reasonably expected by an average user who requests those services; To perform the following services: (1) Helping to ensure security and integrity to the extent the use of the user’s personal information is reasonably necessary and proportionate for these purposes; and (2) Undertaking activities essential to providing the service and to verify or maintain the quality the service and to improve, upgrade, or enhance the service. As authorized by further regulations. Since sharing certain sensitive personal information is essential for us to deliver our services, users are unable to opt-out of this sharing.
Right to Deletion	As a service provider, we collect, process, store, and archive data on behalf of the school and/or school district. If you wish to request the deletion of your personal information, please contact the school and/or school district directly, who will then communicate with us to facilitate the deletion process as appropriate. Please be aware that certain state and federal regulations may prevent the deletion of specific information. These regulations are in place to ensure compliance with legal obligations and to protect the integrity and security of educational records. Right of Correction	If we maintain inaccurate personal information about you, you have the right to request us to correct that inaccurate personal information. Upon receipt of a verifiable request from you, we will use commercially reasonable efforts to correct the inaccurate personal information.
Protection Against Retaliation	You have the right not to be retaliated against by us because you exercised any of your rights under the CCPA/CPRA. This means we cannot, among other things: • Deny services to you; • Provide a different level or quality of services to you; or • Suggest that you will receive a different level or quality of services. Please note that we may provide a different level or quality of services to you, if that difference is reasonably related to the value provided to our business by your personal information.

Nevada Residents’ Privacy Rights. If you are a resident of Nevada, you have the right to request that we do not sell your “personal information” which is subject to the Nevada Privacy of Information Collected on Internet From Consumers Act (NPICICA).

Please understand that we do not sell any user information, including personal information.

Privacy Rights for Residents of Other States. Depending on your state of residence, you may have certain privacy rights regarding your personal information. These rights can include:

Right to Confirm and Access: You may have the right to confirm whether we are processing personal information about you and to request access to the personal information we hold about you.

Right to Deletion: You may have the right to request that we delete your personal information, subject to certain exceptions.

Right to Data Portability: You may have the right to request a copy of your personal information in a portable and readily usable format.

Please note that as a service provider, we collect, process, store, and archive data on behalf of the school and/or school district. You may be required to contact the school and/or school district directly to exercise a specific right described. The school and/or school district will then communicate with us to facilitate the exercise of the specific right, if available to you.

You may only make a CCPA/CPRA-related data access or data portability disclosure request twice within a 12-month period.

If you choose to contact us directly by email, you will need to provide us with:

Enough information to identify you (e.g., your full name, email address and telephone number);
Information reasonably necessary to verify your identity and authority to make the request. We will not request more information than reasonably necessary for verification; and
A description of what right you want to exercise and the information to which your request relates.

We are not obligated to make a data access or data portability disclosure if we cannot verify that the person making the request is the person about whom we collected information or is someone authorized to act on such person’s behalf.

Any personal information we collect from you to verify your identity in connection with your request will be used solely for the purposes of verification.
